These terms and conditions do not affect your statutory rights. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. Availability Whilst we endeavour to only show items on the website that are in stock, goods are subject to availability. If we do not supply the goods for any reason we will not charge you for these goods and we will refund any money already paid for the goods. However, we will not be responsible for compensating you for any other losses which you may incur if we do not supply goods. Delivery We will endeavour to deliver goods within 5 working days, following clearance of your payment. Goods are subject to availability and delay in delivery of goods is sometimes outside of our control. We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods unless caused by our negligence. Should delivery be delayed for more than 21 days you have the right to contact us and cancel your order. In this case we will refund any money paid by you for the goods. As soon as we have delivered the goods you will be responsible for them. If you delay accepting a delivery, our responsibility for everything other than damage due to our negligence will end on the date the carrier tried to deliver the goods to you. Returns Policy All goods are sold as perfect. We are happy to replace or refund and pay return standard carriage (within 28 days) any defective items if returned with proof of purchase when faulty materials or workmanship has caused the problem. However if the item has been damaged due to misuse, mishandling or after fair wear and tear The Bag Shop accepts no responsibility whatsoever. As a gesture of goodwill we will also refund any new and unused item if returned within 28 days and still with swing tags and original packaging. If luggage is damaged while in transit, it is down to you to take the matter up with the relevant party i.e. Airline, Bus Company, Tour Operator or Insurance Company. This does not affect your statutory rights. Descriptions All images, descriptive matter, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods. Whilst we endeavour to show an accurate colour image, you are advised that there may be variations in colour between the actual goods you receive and the image that you see on your monitor. However, if you purchase any goods that you are not happy with, you have the right to return them, unused and in their original packaging, for a full refund within 7 days. You are responsible for the cost of delivery to our premises. All brand names, logos, trademarks and company names shown on this website are acknowledged as being the property of their respective holders or owners. Tax All prices on our website are inclusive of VAT at the current rate. Delivery is free within the Uk. You will only own the goods once we have received payment in full. Complaints If you have a complaint please contact us using the contact form. We aim to resolve disputes when they first arise. If goods arrive damaged or are faulty you must send a returns request via the contact form on the contact page, within 7 days and preferably within 48 hours. You will be responsible for returning the goods which we will replace at no charge or refund any money paid for the goods. Law The Contract between us shall be governed by the laws of England and Wales and any dispute will be resolved exclusively in the courts of England, Scotland and Wales.
